Which 235 Patents?

By Adrian Wong - May. 14, 2007

Microsoft says 'what is fair is fair'! What a crock! How about not pulling a sco and showing us which patents are being infringed upon. IANAL, but let's hope this case brings the supreme court opinion that many patents were, basically, invalid. For now, let's see which patents are claimed and we can take it from there!

That has not yet been announced. Stallman actually noted that Linux itself infringed on 283 patents. Of course, Microsoft attempting to exert control on which version of OSS was 'blessed' by them will not go down well with Stallman!

Sun is already pressing Microsoft not to make any moves here (duh!), since it might conflict with the terms they have in their agreement. Trust microsoft to try and confuse the heck out of the customer!

It is not known if the Free Software Microsoft mentioned actually infringe on anything. Microsoft is refusing to give extensive details on what code infringes in the patents or even what patents are infringed. I suspect Microsoft is trying to get customers nervous about Linux, such as with their threat to sue individual users.

it's not up to MS to tell you the patents, it's up to YOU to do you're own patent seaches, to make sure you are not in breach.

Someone invents something, if they think it's unique, they do patent searches and determine that a patent has not allready been submitted for that idea.

If it has, bad luck, no prizes for second, if not, and you think it's a good enough idea, you apply for a patent.

So the onus is on you, not MS, they are not going to hold you're hand and explain every patent to you.

that's you're job, as a responsible developer, (if you are)
